AGREEMENT TO FOLLOW DIRECTIONS

In exchange for participation in the activity of indoor cycling, yoga, and activities organized by CHVRCH, of 126 West 900 South, Salt Lake City, Utah, 84111 and/or use of the property, facilities and services of CHVRCH LLC, I, (Yourself), agree for myself and (if applicable) for the members of my family, to the following:
I agree to observe and obey all posted rules and warnings, and further agree to follow any oral instructions or directions given by CHVRCH, or the employees, representatives or agents of CHVRCH.

PRIVACY POLICY

This Privacy Notice for CHVRCH LLC (“we”, “us”, or “our”), describes how and why we might access, collect, store, use, and/or share (“process”) your personal information when you use our services (“Services”), including when you:

• Visit our website at www.chvrchcycle.com, or any website of ours that links to this Privacy Notice
• Download and use our mobile application (CHVRCH), or any other application of ours that links to this Privacy Notice
• Engage with us in other related ways, including any sales, marketing, or events

We collect personal information (such as, but not limited to, names, phone numbers, email addresses, mailing addresses, billing addresses, debit/credit card numbers) that you voluntarily provide to use when you register on the Services, express an interest in obtaining information about us or our products and Services, when you participate in activities on the Services, or otherwise when you contact us.

We process your information to provide, improve, and administer our Services, communicate with you, for security and fraud prevention, and to comply with law. We may also process your information for other purposes with your consent.

We will only keep your personal information for as long as it is necessary for the purposes set out in this Privacy Notice, unless a longer retention period is required or permitted by law (such as tax, account, or other legal requirements). No purpose in this notice will require us to keep your personal information for longer than the period of time in which users have an account with us.

If you would at any time like to review or change the information in your account, you can log into your account settings and update your user account. If you would at any time like to terminate your account, please contact us at frontdesk@chvrchcycle.com. Upon your request to terminate your account, we will deactivate or delete your account and information from our active databases. However, we may retain some information in our files to prevent fraud, troubleshoot problems, assist with any investigations, enforce our legal terms and/or comply with applicable legal requirements.

ACCIDENT WAIVER AND RELEASE OF LIABILITY

1. ASSUMPTION OF RISK. I HEREBY ASSUME ALL OF THE RISKS OF PARTICIPATING IN ANY/ALL ACTIVITIES OR EVENTS ASSOCIATED WITH AND/OR ORGANIZED BY CHVRCH  LLC, A UTAH LIMITED LIABILITY COMPANY, including by way of example and not limitation, any risks that may arise from negligence or carelessness on the part of the persons or entities being released, from dangerous or defective equipment or property owned, maintained, or controlled by them, or because of their possible liability without fault.

2. PHYSICAL QUALIFICATIONS. I certify that I am physically fit, have sufficiently prepared or trained for participation in this activity, and have not been advised to not participate by a qualified medical professional. I certify that there are no health-related reasons or problems which preclude my participation in this activity.

3. ACKNOWLEDGEMENT OF RELEASE. I acknowledge that this Accident Waiver and Release of Liability Form will be used by the event holders, sponsors, and organizers of the activity in which I may participate, and that it will govern my actions and responsibilities at said activity.

4. RELEASE. In consideration of my application and permitting me to participate in this activity, I hereby take action for myself, my executors, administrators, heirs, next of kin, successors, and assigns as follows:

(A) I WAIVE, RELEASE, AND DISCHARGE from any and all liability, including but not limited to, liability arising from the negligence or fault of the entities or persons released, for my death, disability, personal injury, property damage, property theft, or actions of any kind which may hereafter occur to me including my traveling to and from this activity, THE FOLLOWING ENTITIES OR PERSONS: CHVRCH LLC, (“CHVRCH Cycle”) and/or their owners, founders, employees, volunteers, representatives, and agents, and the activity holders, sponsors, and volunteers;
(B) HOLD HARMLESS AND PROMISE NOT TO SUE the entities or persons mentioned in this paragraph from any and all liabilities or negligence claims made as a result of participation in this activity, whether caused by the negligence of release or otherwise.

5. ACKNOWLEDGEMENT OF THIRD PARTIES. I acknowledge that CHVRCH Cycle and their owners, founders, employees, volunteers, representatives, and agents are NOT responsible for the errors, omissions, acts, or failures to act of any party or entity conducting a specific activity on their behalf.

6. ACKNOWLEDGEMENT OF RISKS. I acknowledge that this activity may involve a test of a person’s physical and mental limits and carries with it the potential for death, serious injury, and property loss. The risks include, but are not limited to, those caused by facilities, temperature, condition of participants, equipment, lack of hydration, and actions of other people including, but not limited to, participants, volunteers, monitors, and/or producers of the activity. These risks are not only inherent to participants, but are also present for volunteers.

7. APPLICABLE LAW. Any legal or equitable claim that may arise from participation in the above shall be resolved under Utah law. This Accident Waiver and Release of Liability shall be construed broadly to provide a release and waiver to the maximum extent permissible under applicable Utah law.

8. CERTIFICATION OF UNDERSTANDING. I CERTIFY THAT I HAVE READ THIS DOCUMENT AND I FULLY UNDERSTAND ITS CONTENT AND HOW IT AFFECTS MY LEGAL RIGHTS. I AM AWARE THAT THIS IS A RELEASE OF LIABILITY AND A CONTRACT AND I SIGN IT OF MY OWN FREE WILL.

CANCELLATION POLICY

In order to cancel a CHVRCH class, you must unreserve 8 hours prior to the class start time. You can cancel your reservation in the following ways:

1. 1. Login to your CHVRCH account and select “Unreserve” next to the class you wish to cancel.
2. Email frontdesk@chvrchcycle.com to have us cancel the class for you.
3. Call 951-707-3894 to have us cancel the class for you.

Cancellations via Instagram, other social media platforms, or text messages are not considered official and you will be subject to cancellation fees. You must cancel yourself a minimum 8 hours prior to the class start time. If you cancel past the described time, a late cancellation fee of $10 will be charged to your account and you will retain the class in your account. If you do not contact to cancel and do not show to class, you will be charged a no-show fee of $10 and will lose the class in your account. 

If you are a client with an unlimited package, you are required to have a card saved to your account. The same cancellation policy applies. If you no show or late cancel to a class, one day will be deducted from your package and your auto debit contract cancelled. The no show and late cancel charges apply to ALL packages regardless of unlimited status or package pricing.

For riders running late: We ask that you email frontdesk@chvrchcycle.com or call us at 951-707-3894 to discuss options. The front desk will hold your reservation for up to 5 minutes. If there is no contact to let us know you are on your way and the 5 minute window has passed, we will lock the front door to avoid class disruption and bikes will be released to the first waitlisted person in studio.
